The Five Guys data breach settlement provides several benefits to those affected by the security incident that occurred around September 2022. Eligible members have two primary options for compensation:

Alternative Cash Payment

Each member can opt for a direct cash payment of $150. It is for those who prefer simple compensation without filing specific expense claims.

Reimbursement for Expenses

Members can claim reimbursements for out-of-pocket costs directly related to the security incident. This includes:

  • Ordinary Expenses (up to $400): These costs include expenses like managing credit reports, administrative fees (such as notary fees and postage), and unpaid time off work taken to address the breach. Additionally, you may be able to claim up to 4 hours of your time at $25 per hour for dealing with the incident.
  • Extraordinary Losses (up to $6,500): For more severe cases, like identity theft or falsified tax returns that led to significant financial losses, members can claim up to $6,500.

Additional Benefits for California Residents

Those living in California at the time of the breach can claim an additional $100, with other eligible payments.

Identity Protection Services

The settlement also gives two years of identity theft protection and credit monitoring services to help protect members from future security risks. Members need to file a claim to activate these services.

The total fund for the settlement is $700,000. Depending on the number of claims filed, the actual payment amounts might be adjusted so that everyone receives a fair share.
